Legal basis for electronic signatures (eIDAS)

Since July 1, 2016, the eIDAS Regulation (EU Regulation No. 910/2014) has formed the legal basis for electronic signatures within the European Union.
eIDAS stands for “Electronic Identification, Authentication and Trust Services” and replaced the previous EU Directive 1999/93/EC. In Germany, the Signature Act (SigG) and the Signature Regulation (SigV) were replaced by the eIDAS Regulation and the new Trust Services Act (VDG).

The aim is to standardize, recognize, and promote electronic signatures, seals, and identification procedures throughout Europe—for secure and uniform digital communication in the EU.

The regulation defines the legal framework for electronic signatures, electronic seals, time stamps, and identification procedures, setting binding security levels for natural and legal persons.
As a “regulation,” eIDAS applies directly in all member states—national implementation is not required.
